Can Foreigners Really Own Property in Dubai? The Complete 2026 Guide

What Is Freehold Ownership in Dubai?

Freehold ownership means you own the property and the land it sits on outright — permanently, with no expiry date. You can sell it, rent it out, pass it to your heirs, or leave it empty. There are no restrictions on what you do with it.

This is different from leasehold ownership, where you own the property for a fixed term (typically 99 years) but not the land beneath it. Dubai offers both, but for international investors, freehold is almost always the better option.

The UAE government introduced freehold ownership for non-nationals in 2002, and it has since become one of the most attractive property markets in the world for international buyers.

Which Areas Allow Foreign Freehold Ownership?

Not every part of Dubai is open to foreign freehold ownership — but a large and growing number of areas are. These are known as designated freehold zones, and they include some of the most desirable locations in the emirate.

How Does the Buying Process Work?

The Dubai property buying process is well-regulated and relatively straightforward. Here is a step-by-step overview:

Step 1: Choose your property

Whether you are buying off-plan (directly from a developer before completion) or on the secondary market (from an existing owner), the first step is identifying the right property for your goals. Step 2: Reserve the property

For off-plan purchases, you typically pay a reservation fee (usually 5–10% of the purchase price) to secure the unit. This is held by the developer and forms part of your down payment.

Step 3: Sign the Sales and Purchase Agreement (SPA)

The SPA is the legally binding contract between you and the developer (or seller). It sets out the full purchase price, payment schedule, handover date, and any other terms. Read it carefully before signing.

Step 4: Pay the Dubai Land Department (DLD) fee

All property transactions in Dubai are subject to a 4% transfer fee payable to the Dubai Land Department. This is typically split between buyer and seller, though for off-plan purchases it is usually paid by the buyer.

Step 5: Register the title deed

Once payment is complete, the property is registered with the Dubai Land Department and a title deed is issued in your name. This is your proof of ownership.

Step 6: Receive your property

For off-plan purchases, you will receive the property at handover — typically 2–4 years after purchase for new developments. For secondary market purchases, handover happens much faster.

What Does It Cost to Buy Property in Dubai?

Beyond the purchase price itself, buyers should budget for the following costs:

  • Dubai Land Department (DLD) fee: 4% of the purchase price
  • Real estate registration fee: AED 2,000–4,000 (approximately USD 545–1,090)
  • Agent fee: 2% of the purchase price (if using a registered agent — IBC LLC charges no fee to buyers)
  • Mortgage registration fee: 0.25% of the loan amount (if financing)
  • Service charges: Annual fees for building maintenance, typically AED 10–30 per square foot depending on the development

For off-plan purchases, many developers offer flexible payment plans — often 1% per month during construction, with a balloon payment at handover. Some developers also offer post-handover payment plans, allowing you to pay a portion of the purchase price after you receive the keys.

Do You Need to Be in Dubai to Buy?

Can You Get a Mortgage as a Foreign Buyer?

Yes, several UAE banks offer mortgages to non-residents, though the terms are typically less favourable than for UAE residents. Non-residents can usually borrow up to 50% of the property value (compared to 75–80% for residents), and interest rates tend to be higher.

For most international investors, off-plan payment plans are a more attractive option than a mortgage — they spread the cost over the construction period without the need for bank financing.

What About the UAE Golden Visa?

A property investment of AED 2,000,000 (approximately USD 545,000) or more qualifies you for a UAE Golden Visa — a 10-year renewable residency visa for you and your immediate family. This is one of the most compelling reasons international investors choose Dubai over other markets.

The Golden Visa gives you the right to live, work, and study in the UAE, and it can be renewed indefinitely as long as you maintain the qualifying investment. You do not need to live in the UAE to hold a Golden Visa.

Is Dubai Property a Good Investment?

Dubai consistently delivers some of the highest rental yields of any major global city — typically 5–8% gross, compared to 2–4% in London, Paris, or Sydney. Combined with zero income tax, zero capital gains tax, and a USD-pegged currency, the net returns for international investors are exceptionally strong.

The market has also shown strong capital appreciation in recent years, driven by population growth, infrastructure investment, and increasing demand from international buyers and expats.

That said, like any property market, Dubai is not without risk. Off-plan purchases carry developer risk (though this is mitigated by the Dubai Land Department's escrow requirements), and rental yields vary significantly by location and property type.
